This Lower.com Giveaway of Columbus Crew season tickets (the “Ticket Giveaway”) is only open to legal residents of Ohio who are 18 years of age or older as of the date of entry. Employees and immediate family members (spouse, parents, siblings, and children) of Released Parties are ineligible to participate in the Ticket Giveaway.
Ticket Giveaway begins October 13, 2021 (12:00 am EST) and ends at the earlier of (i) Sponsor having awarded one-thousand (1,000) Prizes or (ii) 11:59pm EST on March 1, 2022.
For one (1) entry, during the Promotion Period, go to the following URL, www.lower.com/crew, and follow the instructions to 1) Submit a home mortgage application; and 2) Consummate the loan with Lower, LLC (“Lower”, or “Sponsor”) by becoming contractually liable for the proposed loan as determined by Sponsor. Only one entry per person. All entries become the property of Sponsor. Entrants must fully complete all non-optional data fields on the entry form and truthfully submit all requested data to be eligible. Incomplete entries are void. All entrants must apply through the www.lower.com/crew to be eligible for a Prize. No alternative forms of entry will be accepted. Entrants agree to be absolutely bound by the these rules and the decisions of the judging organization regarding all aspects of the Ticket Giveaway, whose decisions shall be final. All loan applications ARE subject to underwriting and credit approval, to include acceptable collateral.
Released Parties are not responsible for incomplete entries or late or lost entries due to data or computer errors and/or glitches. Automated entries are prohibited, as are mechanically reproduced or photocopied entries, and any use of such automated devices and/or copies will cause disqualification. Sponsor reserves the right in its sole discretion, to disqualify any individual (and all associated entries) who Sponsor believes has tampered or attempted to tamper with the entry process. Subject to applicable law, Sponsor reserves the right, in its sole discretion, to modify, suspend, and/or terminate this Ticket Giveaway (or any portion thereof) for any reason, including should virus, worms, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or proper play or submission of entries of the Ticket Giveaway. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE URL OR UNDERMINE THE LEGITIMATE OPERATION OF THIS TICKET GIVEAWAY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY PERSON(S) RESPONSIBLE FOR ANY SUCH ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
One prize will be awarded to each of the first one thousand (1,000) eligible entrants who successfully enter the Ticket Giveaway and become contractually liable for a proposed mortgage transaction with Lower, LLC (each an “Eligible Entrant”) as set forth below. Each of the Credit Prize and the Ticket Prize shall be referred to herein as the “Prize”. All Prize details are at the sole discretion of Sponsor and are subject to change.
a. Ticket Prize. An Eligible Entrant who is not a 2022 Columbus Crew season ticket member shall receive two (2) Columbus Crew tickets for each 2022 MLS regular season match played by the Columbus Crew at Lower.com Field located at 96 Columbus Crew Way, Columbus, OH 43215 (the “Ticket Prize”) (Ticket Prize details, including the seating location, will be determined by Sponsor or its designee in their sole discretion); and
b. Credit Prize. An Eligible Entrant who has purchased a 2022 Columbus Crew full season ticket package directly from the Columbus Crew shall receive a credit to their account with the Columbus Crew having a value equal to the price of their 2022 full season ticket package in an amount not exceed $1,200.00 (the “Credit Prize”); total Credit Prize may adjusted in accordance with these rules and the Columbus Crew Ticketing terms and applicable rules and guidelines. Use of tickets to Columbus Crew home matches are subject to the Columbus Crew Ticketing Terms located at https://www.columbuscrew.com/tickets/terms-conditions. Prizes may not be sold, substituted for cash value, or transferred to any third party except as explicitly provided for in these Official Rules. All costs and expenses associated with the acceptance and use of a Prize not specified herein as being awarded, including, but not limited to, all federal, state and local taxes and any travel required for Prize redemption, are winner’s sole responsibility, and winners shall indemnify and hold the Released Parties harmless in all respects related thereto. Prizes are issued at the sole discretion of Sponsor and are not redeemable for cash and may not be used for any commercial or trade purposes (e.g., resale for non-personal, business use; advertising; promotions; contests; giveaways; gambling or gaming activities). Use of the Prize in violation of any law, including the unlawful resale or unlawful attempted resale of the Ticket Prize, is prohibited and will result in seizure, revocation and/or forfeiture of the Prize without refund or compensation. No substitutions for the Prize. All Prizes are courtesy of Lower.
The first one thousand (1,000) Eligible Entrants to apply for and consummate a proposed mortgage loan in accordance with the terms, conditions, and official rules of the Ticket Giveaway shall receive a Prize.
By entering, entrants agree to be bound by these rules and to the decisions of the Sponsor, which will be final and binding in all respects. Winners will be notified by Lower, LLC throughout the Promotion Period via telephone and/or e-mail upon successful consummation of the mortgage transaction as determined by Sponsor. Non-compliance with the foregoing or with these Official Rules in anyway, the inability to contact the entrants, any rejection or return of the Prize or notification thereof as non-deliverable may result in disqualification.
In consideration for being awarded the Prize, entrant grants (and agrees to confirm grant in writing promptly upon request) to Released Parties and those acting under Sponsor’s authority, the right to the use of his/her name, photograph, likeness, voice, image, statements and biographical information, at any time or times, for advertising, trade, publicity and promotional purposes in any media now known or hereafter discovered, worldwide, including the Internet without review, notification or approval, and additional compensation or remuneration of any kind, unless prohibited by law.
Entrants agree to the collection of their personal information for the purposes described herein (including the administration of the Ticket Giveaway) in accordance with Sponsor’s privacy policy. By entering this Ticket Giveaway, entrant gives his or her express permission to be contacted by Lower, LLC by telephone, cell phone, e-mail and/or postal mail for purposes of providing current or future financial products that may be of interest. By entering this Ticket Giveaway, entrant consents to the sharing of entrant’s email address with the Columbus Crew for marketing and promotional purposes. Please review Lower’s Privacy Policy for additional details. If you do not wish to receive such financial information that may be beneficial or receive marketing and promotional communications from the Columbus Crew, please refrain from entering into this Ticket Giveaway.
Neither Sponsor nor any of the Released Parties shall be liable in the event that any portion of the Ticket Giveaway or prize is canceled due to weather, fire, strike, acts of war or terrorism, or any other condition beyond their control (a “Force Majeure Event”).
All entrants should recognize and accept the inherent risk before, during or after a match, including the risk of contracting a communicable disease or illness, the risk of physical injury or death, however caused, whether by players, by other people or by objects such as balls entering the spectator area, or otherwise, and the risks of lost, stolen or damaged property.
By entering, as permitted by applicable law, entrant agrees to follow these rules and to fully release, hold absolutely harmless and fully indemnify Lower, LLC, the Columbus Crew (including Crew SC Team Company, LLC and Crew SC Stadium Company, LLC), Major League Soccer, L.L.C., and Soccer United Marketing, LLC and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers and advertising and promotion agencies, and any and all other companies associated with the Ticket Giveaway and each of their directors, officers, employees, agents and assigns (collectively, “Released Parties”), from and against any and all liability, damages, claims or causes of action (however named or described), with respect to or arising directly or indirectly out of either (i) entrant’s participation in the Ticket Giveaway; or (ii) entrant’s receipt or use or misuse of any Prize or any activities associated with the Prize and Prize redemption (including all entrant tax liabilities and travel associated with Prize redemption). By accepting a Prize, subject to applicable law and Lower’s terms of use, Prize recipient agrees that neither the Sponsor nor any of the Released Parties will have any liability whatsoever for, and shall be held harmless by winner against, any liability for injuries, losses or damages of any kind to persons or property resulting in whole or in part, directly or indirectly, from participation in the Ticket Giveaway or from acceptance, possession, misuse or use of a prize. The successors, heirs, and assigns of entrants and potential winners are subject to the terms of these Official Rules.
False or deceptive entries or acts will render the entrant ineligible. ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS TICKET GIVEAWAY IN ANY WAY, OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS TICKET GIVEAWAY, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WILL DISQUALIFY ANY ENTRANT RESPONSIBLE FOR THE ATTEMPT AND, EACH OF SPONSOR AND THE COLUMBUS CREW RESERVES THE RIGHT TO SEEK ANY AND ALL REMEDIES AVAILABLE FROM ANY SUCH PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMISSIBLE BY LAW.
